1. Who we are

EcoPassport AI is operated by Aitbaev Nursultan, an individual seller based in Slovakia ("we", "us", the "Seller"). By creating an account or using the service, you enter into a contract with the Seller and agree to these Terms. If you use the service on behalf of an organization, you confirm you have authority to bind that organization.

2. The service

EcoPassport AI is a B2B SaaS tool that converts construction estimates, invoices and specifications into EU-oriented ESG material passports and carbon reports using automated extraction and matching against environmental product declaration (EPD) factor data.

3. Accounts

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Acceptable use

You must not misuse the service. In particular, you must not:

• use the service for any unlawful purpose, fraud or spam;
• infringe intellectual-property rights of any third party;
• interfere with the security of the service, including introducing malware, probing or scanning for vulnerabilities, or scraping the service;
• reverse engineer the service, resell or redistribute it, or circumvent plan limits or technical restrictions.

5. AI-generated output

Reports are generated with AI assistance and may contain inaccuracies. You are responsible for reviewing and verifying results (including extracted line items, matched EPD factors and calculated values) before relying on them, and for ensuring you have the rights to the documents you upload. Outputs are not a substitute for regulated professional advice (e.g. certified auditing) without appropriate human oversight.

6. Intellectual property

We retain all ownership of the service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You retain ownership of the documents you upload and the reports generated for you; you grant us a limited license to host and process your content solely to provide the service. Rights holders may contact us to request removal of infringing content; repeated infringement may lead to account termination.

7. Payments and subscriptions

Paid plans (Starter, Pro) are billed monthly via our payment provider. Free trials require a payment card and convert to a paid subscription unless cancelled before the trial ends. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Service level

We work hard to keep the service reliable but do not guarantee uninterrupted or error-free performance. The service is provided "as is"; to the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your projects and reports may be deleted after a reasonable export window.

11. General

These Terms are governed by the laws of Slovakia. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control.
